The buyer accepts the responsibility of caring
for this cat/kitten and providing properly for its
welfare. The buyer agrees never to allow this
cat/kitten outdoors.
The buyer agrees that this cat/kitten will never
be sold, leased or given to any pet shop, animal
shelter, research laboratory or similar facility.
This cat/kitten is being sold for the exclusive
use in the buyer’s breeding program. The buyer
agrees this cat/kitten will never be leased or sold
to another cattery or individual nor will it be sent
to another cattery or individual for stud service or
to be used as stud. The buyer agrees that under NO
CIRCUMSTANCE will this cat/kitten be placed with any
other individual or cattery for the purpose of
breeding. The buyer agrees this cat/kitten will
never be co-owned with anyone outside of the buyer’s
immediate household other than Chantilylace cattery,
hereafter referred to as sellers and the sellers
deem this option of retaining co-ownership with the
buyer of this cat/kitten to be necessary. Any
situation in which this cat/kitten does not reside
with the buyer at the buyer's residence will be
interpreted as a direct violation of this clause and
the seller is released from any and all guarantees
and obligations of this contract. The buyer however,
is not released from complying with the other
clauses contained in this contract including but not
limited to payment of the full purchase price. Any
monies previously paid to the seller will not be
refunded to the buyer.
If for any reason, at any time after the buyer
takes possession of the cat/kitten, they no longer
desire to keep this cat/kitten in their breeding
program, the seller has the first right of refusal
to repurchase this cat/kitten. The buyer is required
to notify the seller prior to altering and placing
the cat/kitten in any other home or cattery. The
repurchase price will be the original selling price
less 20% per year for each year the buyer has
possession of the cat/kitten. If the seller chooses
not to repurchase this cat/kitten, the buyer agrees
the cat/kitten MUST BE SPAYED/NEUTERED before being
placed in any other home or cattery for any reason
and the seller is not required to refund any monies.
Any and all guarantees and responsibilities of the
seller related to health, including refunds and or
replacement of this cat/kitten are strictly between
the undersigned seller and buyer and are not to be
considered transferable to any third party.
This cat/kitten is being sold as SHOW
QUALITY/BREEDER By signature, the buyer commits to
show a SHOW QUALITY cat/kitten to its full potential
by agreeing to show it a minimum of four times in
kitten CFA competition and a minimum of four times
in adult CFA competition after it has achieved the
title of Champion/Premier. By signature, the buyer
agrees to show a BREEDER/SHOW QUALITY cat/kitten to
it’s potential in an effort to earn the title of
CFA champion. The buyer is responsible for all show
expenses including but not limited to entry fees,
travel, lodging and meals. If at any time, and
without objective reason(s) in the seller’s sole
opinion, this cat/kitten is not being presented in
top show condition by the buyer, the buyer must stop
showing this cat/kitten in CFA or any registry. The
buyer is not released from full payment of the
purchase price and the seller is not responsible for
any replacement or refund. If at any time, and
without objective reason(s), in the sellers’ sole
opinion, this cat/kitten has not matured to the
breed’s standard, the buyer must stop showing this
cat/kitten in CFA or any registry. The buyer is not
released from full payment of the purchase price and
the seller will replace the cat/kitten with one of
equal quality, in the sole opinion of the seller,
that adequately meets the breed standard, for the
original quality purchased, after veterinary proof
of spay/neuter of the original cat/kitten is
provided to the seller. A replacement will be
provided as available. By signature, the buyer
agrees NEVER to show a BREEDER QUALITY cat/kitten in
CFA or any other registry.
The seller quarantees that its cattery is FELV
& FIV negative and that this cat/kitten is
presently free of disease. This cat/kitten will be
accepted for a full refund of purchase price,
excluding shipping costs, if isolated from other
cats/kittens and taken directly to the buyer’s
veterinarian within 24 hours of the buyer taking
possession of the cat/kitten (or the first working
day following a holiday or weekend) and the
veterinarian finds any health reason why the buyer
should not keep the cat/kitten. In such case, the
buyer agrees to immediately inform the seller and
furnish the clinical veterinary report from the
attending veterinarian. The buyer agrees to isolate
this cat/kitten from all other cats/kittens until
such time it is returned to the seller. This is not
a guarantee against contagious diseases or accidents
encountered after the buyer takes possession of the
cat/kitten and the seller is not responsible for the
veterinary bills related to such.
The seller guarantees that this cat/kitten is
capable of reproduction, and will replace it with a
cat/kitten of equal quality, in the sole opinion of
the seller, if the eventual mating of this kitten
does not produce a live kitten. A replacement will
be provided as available. All medical costs
associated with breeding are the sole
responsibility of the buyer. Inability of this
cat/kitten to reproduce must be documented in
veterinary reports/records presented to the sellers
for review by the sellers’ veterinarian.
The seller warrants that this cat/kitten is
genetically sound, and will replace this cat/kitten
with one of equal quality, in the sole opinion of
the seller, at no additional cost if this cat/kitten
dies from, or is diagnosed with a genetic defect
within 1 year from date of purchase. Said defect
must be evidenced in a necropsy, in the event of
death, or clinical veterinary report, in the event
of a diagnosis. If there is a diagnosis of a genetic
defect, the buyer is required to get a second
opinion from a veterinarian who is not associated in
any way with the original veterinarian. A necropsy
report from the attending veterinarian or the
clinical veterinarian reports from each independent
veterinarian must be presented by the buyer to the
sellers for review by the sellers’ veterinarian. A
replacement will be provided as available. All
veterinarian bills related to the diagnosis and
subsequent treatment and/or the veterinarian bills
related to the necropsy are the sole responsibility
of the buyer.
The buyer acknowledges by signature of this
contract said cat/kitten has not been tested for
Polycystic Kidney Disease (PKD) but has been advised
both parents have tested negative for PKD. The buyer
agrees to have this cat/kitten tested for PKD prior
to breeding and provide proof of testing to the
seller in the form of a veterinary report. If found
to be PKD positive, the seller agrees to re-test the
parents. If the parents test negative, the buyer
agrees, at the buyer’s expense, to have the
cat/kitten re-tested by a radiologist of the seller’s
choosing. If this test is positive, the seller will
replace the cat/kitten with one of equal quality, in
the sole opinion of the seller, after veterinary
proof of spay/neuter of the original cat/kitten is
provided. A replacement will be provided as
available.
The buyer agrees that this cat/kitten WILL NEVER
knowingly be bred to a PKD positive cat. If this
condition is violated, the seller may reclaim this
cat/kitten, and all resulting kittens that have been
produced without a refund of the purchase price.
Veterinary reports/records:
a) For
any reason, failure to provide any requested
veterinary reports and/or records required by this
contract or requested by the seller voids any and
all guarantees and responsibilities of the seller
related to health, genetic soundness, and ability to
reproduce including, but not limited to , refunds
and/or replacement of this cat/kitten. The buyer,
however, is not released from any obligations and
requirements of this contract including but not
limited to payment of the full purchase price.
b) If
after review of the veterinary reports/records by
the sellers’ veterinarian, it is determined that
the death, illness, or reproductive failure(s) was a
result of negligence, mis-diagnosis, improper or
incomplete treatment on the part of the buyer and/or
the buyer’s veterinarian, any and all guarantees
and responsibilities of the seller related to
health, genetic soundness, and ability to reproduce
are voided, including but not limited to refunds
and/or replacement of this cat/kitten. The buyer,
however, is not released from any obligations and
requirements of this contract including but not
limited to payment of the full purchase price.
c) The
professional medical opinion of the sellers’
veterinarian is final in all matters relating to
health, genetic soundness, and the ability to
reproduce of this cat/kitten.
If the buyer declines to accept the replacement
cat/kitten offered by the seller, for any of the
above mentioned causes, the seller is then released
from any and all past, current, and future
obligations for any and all guarantees specified by
this contract, including a replacement cat/kitten.
In such case, the seller is not required to refund
any money already paid and the buyer is not released
from any obligations and requirements of this
contract including but not limited to payment of the
full purchase price. If cat/kitten is replaced the
first cat/kitten must be returned to seller before
buyer obtains replacement cat/kitten. Replacement
cat/kitten is not buyer choice it is sellers. Seller
guarantees replacement to be of equal value of first
cat/kitten.
This cat/kitten is well litter trained, however,
the seller is not responsible if the cat/kitten is
unable to locate it’s litter box in the new home.
Special conditions:

his life.
The buyer agrees that if any terms of this
contract are disregarded and/or violated, the seller
may reclaim this cat/kitten without a refund of the
purchase price. The buyer further agrees to pay all
expenses incurred by the seller in reclaiming the
cat/kitten including all court costs if this
contract is litigated. Additionally, the seller
retains the right to litigate this contract for
damages not to exceed full purchase price plus all
court costs in the event this cat/kitten is no
longer available to be reclaimed due to death or
severe injury of illness. If it becomes necessary to
litigate this contract it will be litigated in the
county of Monroe, in the state of Georgia.
Purchase price shall be US. monies with the
seller paying all costs of flight, carrier and
transfer fees. The deposit if any is nonrefundable
if the buyer terminates the agreement. Deposits will
be refunded prior to the buyer taking possession if
the kitten becomes sick or injured or for any reason
in the sellers sole opinion, does not meet the breed
standard for the quality stipulated.
This cat/kitten will not be co-owned unless the
seller has given her permission.
